01 Acceptance of These Terms

By accessing this site, starting the quiz, completing a quiz, inviting team members, or registering as a manager, you agree to these Terms of Service. If you do not agree, do not use the service.

These terms form a binding agreement between you and TANIA (The AI Native Impact Association), the publisher of the AI-Native Quiz.

02 What This Service Is

The AI-Native Quiz is a free, public self-assessment that scores how "AI-Native" a software developer is across five categories. It is offered as a public service by TANIA. There is no fee to take the quiz, view results, or invite a team.

The quiz is intended for personal self-development and for authorized employer use (where a manager invites their team and reviews aggregated results).

03 Privacy

How we collect, use, store, and share your information is described in our Privacy Policy. By using the service you also agree to the Privacy Policy. If anything in these terms conflicts with the Privacy Policy on a data-handling question, the Privacy Policy controls.

04 Our Intellectual Property. No Copying.

The quiz content (questions, answer choices, the "AI-Native" radar framework, the scoring algorithm, improvement plan copy, category definitions, sample reports, UI design, and supporting code) is owned by TANIA or licensed to TANIA. It is protected by copyright, trademark, and trade secret law.

You may not, in whole or in part, do any of the following without our prior written permission:

• Copy, reproduce, republish, redistribute, mirror, frame, or sell quiz content.
• Screenshot the quiz for the purpose of redistribution, screenshot leaderboards, or screenshot question banks.
• Scrape, harvest, or extract quiz content using automated tools.
• Include quiz content in datasets used to train, fine-tune, or evaluate machine learning or AI models.
• Create derivative works (such as competing quizzes derived from our questions or framework).
• Remove or alter any copyright, trademark, or attribution notices.

You receive a limited, personal, revocable, non-transferable, non-sublicensable license to take the quiz and view your own results. That is all.

05 No Cheating. Honest Answers Only.

The quiz only works if you answer honestly. Cheating defeats the purpose and corrupts our data.

We actively monitor for cheating signals, including but not limited to:

• Opening browser developer tools (DevTools, page inspector, console).
• Viewing or copying the page source.
• Using automation, scripting, bots, or headless browsers.
• Abnormally fast or abnormally uniform answer timing.
• Copying and pasting answer text out of the page.
• Multiple attempts from the same IP address inside the rate limit window.
• Coordinated attempts from related IPs or devices.
• Other behavioral patterns inconsistent with a human taking the quiz in good faith.

If we detect cheating we may, at our sole discretion: invalidate your result, refuse to deliver or display your result, mark your attempt with a flag visible to your manager (if applicable), rate limit or block your IP address, block your email address from future attempts, or terminate your access entirely.

06 No Reverse Engineering

You may not reverse engineer, decompile, disassemble, decrypt, or attempt to derive the source code, algorithms, scoring logic, question selection logic, or proprietary methods underlying the quiz. You may not bypass the per-question timer, the rate limit, the email-verification step, the iframe security boundary, or any other technical measure used to protect the service.

You may not use the quiz, its questions, or its outputs to train, evaluate, benchmark, or fine-tune any machine learning or AI model.

07 No Hacking. No Unauthorized Security Testing.

You may not attempt to gain unauthorized access to the service, other users' accounts, manager dashboards, employee results, our infrastructure, our databases, or our email systems. You may not exploit bugs, attempt SQL injection, attempt cross-site scripting, attempt prompt injection, attempt to escalate privileges, attempt to bypass authentication or authorization, attempt to enumerate tokens or session identifiers, or otherwise probe the service for vulnerabilities without our prior written authorization.

You may not launch denial-of-service attacks, generate excessive load, or otherwise interfere with the availability of the service to other users.

If you believe you have found a security vulnerability, please report it responsibly to [email protected]. Do not exploit it, do not publicly disclose it before we have had a reasonable opportunity to fix it, and do not access data that does not belong to you.

08 Acceptable Use and Scope

The quiz is offered for personal self-assessment and authorized employer team assessment. Any use outside of that intended scope is prohibited, including but not limited to:

• Bulk competitive intelligence gathering against TANIA or other quiz authors.
• Operating a paid service that takes the quiz on behalf of others.
• Using the quiz to gate access to other products or services without our agreement.
• Sharing your verification code, your signed results URL, or your manager session cookie with people who are not entitled to it.
• Submitting prompt injection content, adversarial inputs, or content intended to corrupt scoring, train our systems on hostile content, or defame other users.
• Misrepresenting yourself or your role when registering as a manager (for example, claiming to be a manager when you are not).
• Using the service in any way that violates applicable law.

09 The Quiz Is Provided "as is"

The quiz, the website, the results, the improvement plan, and every other part of the service are provided on an "as is" and "as available" basis, with all faults, and without warranty of any kind, express or implied.

To the maximum extent permitted by applicable law, TANIA disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, security, and uninterrupted operation.

We do not warrant that the quiz will be free of bugs, that scoring will be free of errors, that the service will be uninterrupted, or that any defect will be corrected.

10 Do Not Base Decisions on Quiz Results

The quiz is a self-development conversation starter. It is not a professional certification, not a hiring assessment, not a performance review, not a fitness for employment determination, and not an aptitude test in any regulated sense.

We do not recommend or endorse making consequential decisions based on quiz results, including (without limitation):

• Hiring, firing, layoff, promotion, demotion, or compensation decisions.
• Team assignment, project staffing, or role allocation decisions.
• Educational or training enrollment decisions for an individual.
• Career path, school admission, or professional licensing decisions.
• Visa, immigration, or other regulatory filings.
• Any other decision that materially affects a person's livelihood or opportunities.

If you choose to use the quiz as one input among many for any such decision, you do so entirely at your own risk and you assume full responsibility for the decision and its consequences.

11 Accuracy Disclaimer

The "AI-Native" framework, the five radar categories, the question bank, and the scoring weights reflect TANIA's current opinion about what makes a software developer effective at working alongside AI tools. The field is moving very quickly. The quiz may be incomplete, may be wrong in places, may be out of date, and will be revised over time.

Different reasonable experts would design this quiz differently. Treat the result as one data point and not as a definitive measurement of skill, talent, or potential.

12 No Uptime Guarantee

We offer the service on a best-effort basis. We do not guarantee any specific level of availability, uptime, response time, or freedom from interruption. Scheduled maintenance, unscheduled outages, infrastructure failures, third-party provider outages (for example, email delivery, DNS, hosting), and other interruptions may occur from time to time.

We owe you no refund, credit, or other compensation for service unavailability. The service is free.

We may change, suspend, or discontinue any part of the service at any time, with or without notice.

13 Limitation of Liability

To the maximum extent permitted by applicable law, in no event will TANIA, its officers, directors, employees, contractors, sponsors, partners, or affiliates be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages of any kind arising out of or related to your use of the service, the quiz content, your results, your inability to access the service, any errors in scoring, any decision you or another party made on the basis of quiz results, or any other matter related to the service. This includes damages for lost profits, lost data, lost opportunity, reputational harm, emotional distress, or business interruption, regardless of the legal theory (contract, tort, strict liability, or otherwise) and regardless of whether we were advised of the possibility of such damages.

Because the service is provided to you free of charge, our aggregate liability to you for any and all claims relating to the service is limited to the greater of (a) the amount you actually paid us for the service (zero) or (b) fifty US dollars (US$50).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the limitations above apply to the maximum extent permitted by law.

14 Indemnification

You agree to defend, indemnify, and hold harmless TANIA, its officers, directors, employees, contractors, sponsors, partners, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: your misuse of the service; your breach of these terms; your violation of any law or regulation; your infringement of any third-party right; any decision made by you or your organization based on quiz results; and any content you submit or transmit through the service.

15 Termination

We may suspend, restrict, or terminate your access to the service at any time, for any reason or no reason, with or without notice, including (without limitation) for any violation of these terms, suspected cheating, suspected security probing, suspected scraping, or suspected misrepresentation.

On termination, your right to use the service ends immediately. Sections of these terms that by their nature should survive termination will survive, including sections 04 (intellectual property), 09 (as is), 10 (no decisions), 13 (limitation of liability), 14 (indemnification), 17 (governing law), and 18 (contact).

16 Changes to These Terms

We may update these terms from time to time. When we do, we will update the "Effective" date at the top of this page and, if the change is material, we may also notify registered managers by email. Your continued use of the service after the effective date of the revised terms constitutes acceptance of the revised terms. If you do not agree to the revised terms, your only remedy is to stop using the service.

17 Governing Law and Venue

These terms and any dispute relating to the service are governed by the laws of the State of Delaware and the applicable laws of the United States, without regard to conflict-of-laws principles. You agree that the exclusive venue for any legal action arising out of or relating to these terms or the service will be the state and federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

Before bringing any formal legal action, you agree to contact us at [email protected] and give us thirty (30) days to resolve the dispute in good faith.

You agree that any dispute will be resolved on an individual basis. You waive any right to participate in a class action, class arbitration, or representative action.
